MATERIALS TOOLS AND SUNDRIES

The buyer is strongly recommended to test all materials and articles before using them, if any fault in any materials or in the case of an article, and fault due to bad workmanship, or material is proved, and the material and/or article is returned within one month of the same having been delivered to the  seller will at its cost, replace the faulty material and/or article. The client will not be liable for any consequential loss or damage of whatever nature, however caused, whether by negligence or otherwise and subject aforesaid, all express or implied warranties or conditions as to quality or fitness for any purpose of the goods are expressly excluded and the buyer shall indemnify the seller against any claim respect of the good by any third party.

KILNS, MACHINERY AND EQUIPMENT

All kilns, machinery and equipment are constructed with great care, and tested prior to dispatch, but despite the care exercised should any item of equipment or part thereof (other than elements) prove defective as a result of any faulty workmanship or materials, fair wear and tear excepted, we will make good free of charge the defective or (at our option) replace the defective article or part provided it to be recognized that this is the fullest extent of our liability, and that we accept no further responsibility for any consequential damage incurred. We shall be under no obligation to make good or replace any article unless

Written notice of the supported by full particulars together with full identification the article or part in question is given by the purchaser to us within a period of six months after the dispatch by us of that article or part;

The defective article or part is promptly returned to us;

The defective part of an article has not been interfered or tampered with and no substitute part has been fitted without our approval.

ELEMENTS

We make no representative as to the use or uses to which any of our kilns may be adaptable or suitable. Moreover, having no control over the firing method to which these kilns may be subjected after leaving our works we are unable to and not assume any responsibility for the element life obtained. If any element suffers breakages as a result solely of transport or initial stresses we will make good free of charge (at our option) replace the element, provided that notice of the breakage, supported by full Identification of the element of question is given by the purchaser to us within twenty eight days after the dispatch of the element to us and the broken element is promptly returned at the senders wish and express properly labeled for identification.

PERFORMANCE

All performance figures given by us are based on experience and are such we expect to obtain on test. They are given in good faith without commitment.

INSTALLATION

standard electric kilns and/or machinery are supplied complete and ready for connections to the clients supply point , and unless an agreement has to be made to the alternative we assume that arrangements to have the kiln and/or machinery connected to the electrical supply to be at the clients responsibility.

3 PRICES

All prices are subject to fluctuation without notice and all orders will be invoiced at prices ruling at date of dispatch unless other wise agreed

3(2) Quotations given will remain firm for a period of twenty eight days from the date given, unless otherwise stated.

3(3) All prices quoted, or shown in the seller’s price list are ex-works, Bodmin, unless otherwise agreed.

3(4) All prices are exclusive of V.A.T.

4 DESCRIPTIONS AND SPECIFICATIONS

All descriptions and specifications shown in the catalogue or other literature are intended merely to present a general idea of the goods described, and shall not form part of the contact. In accordance with the sellers policy of constantly improving products they reserve the right to change the specification or delete items from the catalogue, price lists and other literature without prior notice.

5 DELIVERY

Although delivery date are given in good faith, and every effort will be made to adhere to dates given, such dates shall not be binding, and the sellers will be under no liability for any loss or damage of whatever nature caused by any delay.

6 PAYMENT

6.(1) All orders must be accompanied by a cheque or postal order of the order including carriage, excepting as stated below.

6.(2) Credit accounts will be opened automatically for local and similar education   authorities. Credit terms will be allowed for other customers whose orders are above the stipulated value and who provide satisfactory trade references.

6.(3) Payments of credit accounts will be made 30 days from the date of invoice, unless otherwise agreed.     

INTEREST ON OVERDUE ACCOUNTS                                                                                                       If accounts are not paid within the specified period we reserve the right to charge interest at the rate of 2% per month on any amounts overdue.

7 CARRIAGE

All goods are supplied ex-works, Bodmin. A guide to carriage charges is shown in the price list and these prices allow for goods to be delivered on board transport to the consignees premises. Off loading and moving into position shall be the purchaser’s responsibility, unless special arrangements have been made.

8 PACKING

All raw materials, glazes and colors and oxides and most tools and equipment are packed in non-returnable packing which is not included in the price shown in the price list. Extra charges for packing larger items, e.g. kilns, machinery, are shown but these charges will be credited in full if returnable  if packing is returned to the sellers within a period of three months from the date of invoice, in good condition. Under no circumstances will credit be allowed or deducted unless supported by a credit note issued by the sellers.

9 ORDERS ONLY ACCEPTED SUBJECT TO THESE CONDITIONS

Products not included in the Cat/Price list can be quoted for upon application.
